Oshkosh group wrongly produces ad with Depp photo

OSHKOSH, Wis. - A business group had to pay $12,000 in relation to producing an ad that used a photograph of "Public Enemies" star Johnny Depp without permission.

The Downtown Oshkosh Business Improvement District had to reimburse the Oshkosh Northwestern newspaper and the Buyers Guide $12,000 for having to reprint Experimental Aircraft Association guides that included the ad.

District Manager Maureen Strauss said a local resident photographed Depp, but the group did not seek Universal Studios' permission to use Depp's image. Local officials brought it to the group's attention after publications containing the ads had already been printed.

Earlier this year "Public Enemies" filmed in numerous Wisconsin communities, including Oshkosh.

OSHKOSH - A Downtown Oshkosh Business Improvement District advertising campaign cost $12,000 more than expected after publications that included the promotional advertisement had to be reprinted because the ad used a photograph of "Public Enemies" actor Johnny Depp without permission.


BID Manager Maureen Strauss said said the picture of Depp was taken by a local resident, but the BID did not seek Universal Studios' permission to use Depp's image. Local officials brought it to BID's attention after publications containing the ads had already been printed.

The BID Board unanimously approved reimbursing the Oshkosh Northwestern and the Buyers Guide $12,000 for costs related to having to reprint Experimental Aircraft Association guides that included the ad.

To pay for the reprints, the BID's Board of Directors used $3,000 that had been budgeted for a Movies in the Park program that had been previously cancelled, $1,350 from general marketing, $1,260 left over from operating a trolley during EAA, $1,200 for monthly newsletters, $600 left over from the Destination Downtown event, and approximately $5,000 from the BID's beautification fund.

Using those funds largely helped the BID escape without impacting planned events or other operational programs included in the district's $195,000 budget, Strauss said.

"It's hard to see that total cost number, but we took it from places where the money was unallocated at this point," Strauss said. Board member Megan Hoopman said since the incident occurred, the BID Board has implemented procedures to ensure the same situation does not arise again.
